Overview

Cox Castle has considerable experience representing secured creditors, landlords and opportunistic investors in workouts and bankruptcy matters. Our representations of these clients range from straightforward single asset matters to more complicated organizational structures among all types of real estate asset classes.

Our attorneys routinely advise lenders and borrowers in restructurings, starting at prenegotiation letters through conclusion--whether a restructure, remedies or defense thereto. In many instances, we are able to provide the steadying hand needed to conclude complicated workouts - but in those situations that devolve to litigation or insolvency, our considerable bankruptcy experience, combined with our lending and joint venture experience, provides a complete range of services to investors.

Secured Creditors

Our bankruptcy attorneys advise secured creditors in a variety of matters, including single-purpose entity bankruptcy cases, negotiating consensual plans of reorganization and documenting stipulations for a debtor's use of cash collateral. We also represent post-petition, debtor-in-possession lenders regarding protections that can be achieved through the financing and approval process.

Landlords/Investors

We have substantial experience representing landlords in negotiating favorable terms for the rejection or assumption and assignment of leases by a tenant in bankruptcy. We also counsel opportunistic investors looking to purchase indebtedness of secured creditors or assets out of a bankruptcy. Our considerable bankruptcy experience, combined with our lending and joint venture experience, provides a complete range of services to investors.
