Tough New Emissions Rules Challenged

The Daily Journal reported on December 14, 2010, that the California Building Industry Association has sued the Bay Area Air Quality Management District to block new, stringent emissions standards for new developments. Cox Castle & Nicholson partner Michael Zischke, who represents the 6,500-member association, said, “the guidelines will significantly affect the location, type and amount of development in the Bay Area.” He added that the standards will “discourage the very type of infill, transit-oriented, and mixed-use development necessary to achieve state air quality goals, including those related to greenhouse gas… emissions.”
