Jonathan Kitchen, a litigation partner with Cox Castle & Nicholson in San Francisco, wrote an article that appeared in the March 24, 2011 issue of the Daily Journal. The article, “Keep Track of Former Employees When Downsizing,” explored the differences between state and federal rules when seeking former employees as witnesses in litigation. Noting that former employees may be difficult to locate and produce, Kitchen advised companies reducing their ranks to “make every effort to keep track of those employees, because you never know when you might need them back.”
