ICSC+U.S. Law Conference - Workshop CLE Course

Travis Jeffries lead a CLE workshop for attorneys regarding the remedies for the violation of an exclusive use provision, as demonstrated by an analysis of recent cases. The discussion examined whether the remedy clauses were effectively drafted and what improvements would yield a better result from both the landlord and tenant perspectives. Alternative exclusive remedies were provided with discussions of the implications of various concepts, such as carveouts from the exclusive, landlord cure periods, and the length of a tenant remedy.
